WhatsApp and Instagram are built to move conversations fast — not to hold records. That's fine for chatting with a customer. It's a real problem the moment a customer, or a regulator, asks for something a chat thread was never designed to produce.
India's Data Law Doesn't Care Which App You Sell Through
India's Digital Personal Data Protection Act (DPDP), 2023, applies to any business handling customer personal data — and that includes sellers running entirely through Instagram DMs or WhatsApp Business, not just businesses with a formal website. If a customer asks you to delete or hand over the data you hold on them, you're expected to be able to do that, regardless of which app the conversation happened in.
Here's the specific gap: WhatsApp Channels, by design, doesn't let the admin export a contact list. Your customer data lives inside an account you don't fully control the shape of — you can see it, you can message it, but "produce a clean export of everything we hold on this person" isn't something the platform was built to hand you. That's not a hypothetical inconvenience. It's the exact ask a compliance obligation can put in front of you.
GST Invoicing Doesn't Pause Because You're Selling on Social Media
Once a business crosses the standard GST registration thresholds — ₹40 lakh in turnover for goods, ₹20 lakh for services, as a general rule (specific situations vary, and this is worth confirming with an accountant for your own case) — GST-compliant invoicing becomes a real requirement, independent of whether orders come in through a website, a marketplace, or a WhatsApp chat. Neither WhatsApp nor Instagram has a built-in invoicing tool. Sellers who reach that point end up bolting on a separate invoicing process — a spreadsheet, a third-party app, a manual template — next to a sales channel that was never designed to talk to it.
That's manageable at low order volume. It gets genuinely error-prone once you're generating invoices by hand for every order, on top of everything else running a growing store already asks of you.
What an Owned Store Actually Changes Here
None of this requires abandoning WhatsApp and Instagram as places customers discover and message you — that part keeps working exactly as it does today. What changes is what sits behind it: a real customer record per order, and GST-ready invoicing generated as part of the same system that took the order, instead of a separate manual process you maintain on the side. If a customer or a compliance request ever asks "show me what you hold on this person" or "send a proper invoice," the answer already exists instead of needing to be reconstructed from a chat thread.
The Honest Caveat
This isn't legal advice, and GST/DPDP specifics genuinely vary by business situation — talk to an accountant about your actual registration status. What's true regardless of the specifics: a system built to hold customer records and generate proper invoices puts you in a stronger position to answer either question than a chat app does, whatever your particular thresholds turn out to be.
